The following terms and conditions refer to all transactions on www.fouldguitars.com. Foulds Guitars reserve the right to change these terms and conditions at any time.
These terms and conditions do not affect your statutory rights.
Purchasing an item from us indicates your acceptance of these terms and conditions.
Prices and promotions will sometimes be specific to our website and will not be available in our store. We are under no obligation to honour any website price in our store.
We work hard to ensure our website is up-to-date and accurate, however, a price error may occur. If this is the case we will either contact you to ask if you wish to cancel your order, or ask if you wish to proceed with it at the correct price, or we will cancel your order and refund your money. Foulds Guitars are under no obligation to sell goods at the incorrect price.
Prices quoted include VAT at the rate prevailing at the time of purchase.
We accept the following methods of payment: Switch, Solo, Mastercard, Visa, Delta.
Currently we deliver to the UK and Eire only. Please contact us to discuss the possibility of shipping outside this area.
Items are delivered Monday to Friday, except on Bank Holidays.
The delivery address must be the one registered to the credit/debit card being used.
Insurance is included free as part of our ongoing commitment to customer service.
Once a sale has been processed we will email you confirming delivery arrangements.
All purchases will be subject to delivery charges, except where we are running a free delivery promotion. We endeavour to keep delivery costs as low as possible. The cost is dependant on the size and weight of the product, and whether or not the address is to a remote area.
5. Remote Areas
Unfortunately our carrier charges us more for delivery to the Scottish Islands and Highlands, Northern Ireland and Ireland. The costs for delivery will be made clear before a sale is finalised on our website.
All orders made by you through the Website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.
For certain goods, information concerning stock availability is not available on the Website. If you order goods which are not available from stock, we will contact you by e-mail and you will have the option to wait until the goods are available from stock, or cancel your order in accordance with our cancellation and returns policy. In the event your order is cancelled, we will refund any payment already collected from you in respect of that order, in accordance with our cancellation and returns policy.
7. Custom Orders
Some of our products can be custom made to your own specifications. Delivery times will vary on these items, but this will be discussed with you when you place your order.
8. Right to cancel
You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods, or in the case of a contract relating to delivery of a good consisting of multiple lots or pieces, physical possession of the last lot or piece.
To exercise the right to cancel, you must inform us either by post to 39-40 Irongate, Derby. DE1 3GA or by email to firstname.lastname@example.org of your decision to cancel this contract by a clear statement. You may use the attached model cancellation form, but it is not obligatory.
To meet the cancellation deadline, it is sufficient for you to send and for us to receive your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you or failure to return all of the items incuded such as accessories, manufacturer’s packaging or manuals.
We will make the reimbursement without undue delay, and not later than-
(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest
You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired
You will have to bear the direct cost of returning the goods.

9. Faulty Goods
Occasionally there is a manufacturing fault with a product. Please make sure you keep all your packaging until you have checked the product works properly. If there is a fault, please inform us and we will arrange for the item to be collected at our expense. We will then either send you a replacement or offer you a refund.
All new products come with a 1 year manufacturers warranty by default, this does not include perishable items such as strings.
Some manufactures may offer extended warranties with resgistration or payment.
Our used products carry a 3 month parts and labour warranty provided by Foulds Guitars.
Should You have a problem, contact us to discuss the issue and we will endeavour to put things right.

Foulds Guitars reserve the right to change any of our offers without giving notice.
Foulds Guitars is a continuation of a grand tradition of music retail in Derby, borne out of Foulds Music, we are now based in a Victorian Grade 2 Listed Arcade, in the bustling Cathedral Quarter.
